1. Purpose and scope
This Disclaimer applies to property listings, photographs, videos, plans, prices, locations, specifications, features, availability statements, and related content on KevinJBRealEstate.com (the “Website”) or shared from it by Kevin John Barakat. It should be read with the Terms of Use and Privacy Policy.
The Website is a marketing and communication resource. Its content helps visitors identify properties that may deserve further investigation; it is not a substitute for inspection, due diligence, professional advice, or final transaction documents.
2. Sources and independent verification
Listing information may be supplied by an owner, landlord, developer, tenant, representative, photographer, property portal, or another person believed to have relevant information. Kevin may organize, edit, translate, summarize, or format that material for presentation, but may not have independently verified every statement, image, measurement, document, or representation.
Information may change after publication or may contain an error, omission, approximation, misunderstanding, or outdated detail. Visitors should identify what matters to their decision and obtain direct, current verification from persons and professionals with appropriate authority.
3. Availability, prices, and commercial conditions
A property’s availability may change without notice because of a reservation, offer, withdrawal, sale, lease, owner instruction, legal issue, or another event. Website status labels reflect the latest information reasonably available but are not real-time guarantees.
Prices, rent, deposits, payment schedules, commissions, taxes, service charges, maintenance costs, included contents, financing assumptions, currency, and other commercial terms may change and remain subject to confirmation and negotiation. A displayed price is not a binding offer or guaranteed final price.
Any currency conversion is an estimate based on the information or rate used at the time and may not reflect the rate, fees, taxes, or settlement method applicable to a transaction.
4. Areas, measurements, plans, and boundaries
Areas, dimensions, ceiling heights, room sizes, land measurements, shares, boundaries, parking spaces, and similar figures may be approximate, rounded, taken from owner information, or measured using a method different from the legally or commercially relevant method. “Square metres” may refer to internal, external, saleable, gross, net, common, registered, or other measurement concepts.
Floor plans, architectural drawings, maps, diagrams, and boundary illustrations may be simplified, not to scale, outdated, proposed rather than completed, or intended only to show a general arrangement. They do not replace an official title record, cadastral plan, survey, approved permit, completion record, or measurement by an appropriately qualified professional.
5. Photographs, videos, staging, and condition
Photographs and videos show selected views at a particular time. They may not show every room, defect, obstruction, neighboring condition, sound, smell, access issue, or feature. Wide-angle lenses, lighting, exposure correction, cropping, color adjustment, compression, virtual staging, physical staging, illustrative furniture, seasonal conditions, and screen differences can affect appearance and perceived size.
Furniture, appliances, decoration, landscaping, fixtures, finishes, views, and other visible items may be changed, removed, excluded from the transaction, damaged, replaced, or subject to a separate agreement. Construction images, renderings, sample finishes, and promotional illustrations may represent an intended or example result rather than the completed property.
A visitor should inspect the property personally or through a trusted professional and confirm the present physical condition and the items included in any proposed transaction.
6. Locations, access, views, and surroundings
A location description or map marker may identify only the general neighborhood or approximate area, particularly where an exact address is withheld for privacy, security, or owner instructions. It should not be used as proof of a legal boundary, parcel, entrance, right of way, postal address, or exact position.
Views, traffic, noise, light, access, parking, road conditions, utilities, nearby businesses, services, construction, zoning, and surrounding developments may change. A current view may be obstructed by future lawful construction. A stated travel time or distance depends on the route, traffic, weather, mode of transport, and measurement source.
7. Checks visitors should make
Before making an offer, paying money, signing a document, or otherwise relying on a listing, visitors should independently investigate all matters important to them. Depending on the property and transaction, this may include:
- the identity, ownership, legal capacity, and authority of each relevant party;
- title, cadastral records, boundaries, liens, mortgages, charges, disputes, succession matters, and rights of third parties;
- zoning, permitted use, licences, building permits, completion status, violations, and development restrictions;
- structure, systems, water, electricity, generator arrangements, internet, access, common areas, building condition, and required repairs;
- areas, plans, parking, storage, furnishings, fixtures, views, and included contents;
- taxes, service charges, maintenance obligations, deposits, commissions, currency, payment arrangements, and financing;
- tenancies, occupancy, vacancy, possession, management rules, and restrictions; and
- all drafts, disclosures, approvals, and final transaction documents.
Visitors should consult qualified Lebanese legal, financial, tax, engineering, surveying, architectural, valuation, and property professionals appropriate to the transaction.
8. No binding offer, reservation, valuation, or professional advice
A listing, inquiry response, viewing request, social-media post, or other Website content does not constitute a binding offer, acceptance, contract, reservation, title opinion, valuation, appraisal, survey, structural report, engineering advice, architectural advice, financial advice, tax advice, legal advice, investment advice, or guarantee.
Expressions such as “premium,” “investment,” “ideal,” “high-end,” “good value,” or similar marketing descriptions are qualitative opinions or shorthand and should not be treated as objective promises of condition, suitability, return, appreciation, or future performance.
9. Transactions remain subject to documentation
Any proposed sale, lease, reservation, representation, or other transaction remains subject to current availability, identity and authority checks, inspection, negotiation, satisfactory due diligence, proper documentation, required signatures, payment arrangements, and all applicable legal and regulatory requirements.
No visitor should transfer money or disclose sensitive financial information solely because of a Website listing or an unverified message. Payment instructions and the identity and authority of the recipient should be independently confirmed through trusted channels.
10. Fair limits of responsibility
Reasonable efforts may be made to correct a material error once it becomes known. To the extent permitted by applicable law, Kevin is not responsible for a visitor’s decision to rely on information that the visitor was clearly advised to verify independently, or for changes and inaccuracies originating outside Kevin’s reasonable knowledge or control.
This Disclaimer does not excuse or exclude deliberate misrepresentation, fraud, gross negligence, or any duty, liability, remedy, or mandatory consumer protection that cannot lawfully be excluded or limited. Nothing here authorizes misleading advertising or removes a person’s obligation to act honestly.
11. Corrections and contact
If you own, occupy, represent, or have rights in a listed property and believe information is materially inaccurate or no longer authorized, contact Kevin John Barakat at kevinjbrealestate@gmail.com. Please identify the listing and correction without sending unnecessary confidential or identity documents.
A confirmed withdrawal of listing authorization should result in removal or archiving of the public listing within three business days, subject to limited non-public recordkeeping described in the Privacy Policy.
