1. Acceptance and operator
These Terms of Use (“Terms”) apply when you access or use KevinJBRealEstate.com (the “Website”). The Website is operated personally by Kevin John Barakat, a real estate agent serving properties and clients in Lebanon (“Kevin,” “we,” “us,” or “our”). There is currently no registered company operating the Website and no public business office.
By using the Website, you agree to these Terms. If you submit information on behalf of another person or property owner, you confirm that you have authority to do so. If you do not agree, do not submit information and discontinue use of the Website.
2. Website purpose and eligibility
The Website presents real-estate marketing information, contact options, property listings, viewing-request tools, and a facility for owners or authorized representatives to propose properties for review. It is intended for adults who can lawfully communicate about property. You may use it only for legitimate personal or business property purposes and in accordance with applicable law.
The Website is not a transaction platform. It does not accept purchase money, rent, deposits, reservation fees, or legally bind a property transaction through a button, listing, message, or submission.
3. No automatic professional or contractual relationship
Browsing a listing, sending an inquiry, requesting a viewing, or submitting a property does not by itself create an agency, brokerage, representation, advisory, fiduciary, employment, partnership, or other contractual relationship with Kevin. It also does not create exclusivity, reserve a property, constitute acceptance of an offer, or guarantee that Kevin will market a submitted property.
A professional or contractual relationship arises only when the relevant parties separately agree to it with adequate authority and any legally required formality. Website content is general information and marketing, not legal, financial, tax, valuation, architectural, engineering, surveying, or investment advice.
4. Property information, prices, and availability
Listings may contain information supplied by owners, landlords, developers, tenants, representatives, photographers, portals, or other sources. Although reasonable efforts may be made to present useful information, a listing may contain an error, omission, approximation, or outdated detail.
Availability may change without notice. A displayed price, rent, payment schedule, fee, yield, currency conversion, area, feature, or commercial condition is indicative unless confirmed in the final transaction documents. A listing is not a binding offer, quotation, valuation, promise, reservation, or guarantee. Marking a property “available,” “under offer,” “sold,” or “rented” reflects the latest information known at the time but may not reflect an immediate change.

5. Independent verification and professional advice
Before making a decision or commitment, you must independently verify every fact material to you, including ownership, authority to transact, title, encumbrances, permits, zoning, lawful use, boundaries, measurements, condition, utilities, access, service charges, taxes, price, currency, payment terms, availability, contents, and transaction documentation.
You should inspect the property and obtain advice from appropriately qualified Lebanese legal, financial, tax, engineering, surveying, architectural, valuation, and other property professionals. Kevin does not replace those professionals merely by publishing a listing or arranging communication.
6. Inquiries, viewings, and electronic communications
You may contact Kevin through the Website or linked telephone, email, WhatsApp, Gmail, or social channels. You are responsible for the accuracy of the contact details and information you provide. A viewing request is a request only; it remains subject to confirmation, property access, owner or occupant permission, availability, and scheduling.
Electronic communications can be delayed, intercepted, misdirected, or unavailable. Do not send passwords, payment-card data, identification documents, door codes, or unnecessary sensitive information through an ordinary inquiry. Unless separately and clearly agreed, no message constitutes acceptance of a transaction or authorization to transfer funds.
7. Owner and representative submissions
An owner, landlord, developer, tenant, or representative may propose a property for review. By submitting, that person confirms that the information is accurate to the best of their knowledge; that they own the property or have sufficient authority to represent it; and that they may lawfully supply the descriptions, photographs, videos, plans, and other materials.
A submission enters a private pending-review process and is not automatically published. Kevin may request supporting information, decline the submission, ask for changes, or require separate authorization before publication. Submission does not guarantee acceptance, publication, promotion, a viewing, or a transaction.
The submitter must not provide private tenant or occupant information, identification documents, access credentials, confidential contracts, unlawful material, or media depicting people who have not consented where consent is required. The submitter must promptly correct material errors and tell Kevin when authority, price, availability, or property conditions change.
9. Permitted use
You may browse public listings, share ordinary links, make genuine inquiries, request viewings, and submit a property you are authorized to represent. You may save a limited copy of public information for your own property evaluation, provided you preserve notices and do not republish or commercially exploit it.
If you create a client account, you must provide accurate information, keep your sign-in details confidential, and promptly use the recovery process if you believe the account has been compromised. An account is personal to you and must not be used to impersonate another person, access another user’s information, automate abusive activity, or attempt to enter the private administrator area.
10. Prohibited conduct
You must not:
- submit false, misleading, unlawful, infringing, confidential, or malicious content;
- impersonate another person or misrepresent authority over a property or media;
- attempt to access the private administrator area, another person’s records, non-public listings, or restricted systems;
- bypass authentication, rate limits, upload controls, or other technical protections;
- introduce malware, destructive code, automated abuse, denial-of-service traffic, or security-testing activity without written authorization;
- scrape, crawl, harvest, systematically extract, train on, reproduce, resell, or create a competing database from Website content, except ordinary search-engine indexing that follows published instructions;
- interfere with the Website, its providers, or another visitor’s use; or
- use contact information for spam, harassment, discrimination, or an unlawful purpose.
11. Intellectual property and listing materials
The Website’s original design, branding, logo, text, selection, arrangement, and software are owned by or licensed to Kevin and are protected to the extent provided by applicable law. Property media and descriptions may be owned by owners, photographers, developers, Kevin, or other licensors and are used with permission or on the submitter’s representation of authority.
No ownership transfers to a visitor. You may not remove notices, use the KJB identity to imply endorsement, or reproduce substantial Website or listing content without permission. If you believe material infringes your rights, contact kevinjbrealestate@gmail.com with the affected URL, an explanation of your rights, and sufficient contact information. Do not send unnecessary identity documents.
12. Third-party websites and services
The Website may link to WhatsApp, Facebook, Facebook Marketplace, Instagram, LinkedIn, Gmail, telephone applications, mapping tools, video platforms, property portals, and other services. Those services are independently operated and may have different terms, privacy practices, accuracy, security, and availability. A link is provided for convenience and does not guarantee or adopt third-party content.
13. Privacy
The Privacy Policy explains how information is collected, used, shared, retained, and protected. By submitting information, you acknowledge that it will be handled as described there. This acknowledgement does not remove any mandatory privacy right or turn optional information into a requirement.
14. Website availability and changes
The Website may be updated, maintained, interrupted, restricted, or discontinued. Features, listings, links, and presentation may change. Reasonable efforts may be made to restore service and correct known errors, but continuous, immediate, error-free, or permanently preserved access is not promised. We may remove unlawful, unauthorized, unsafe, expired, or inaccurate material.
15. Reasonable disclaimers and limitation of liability
To the extent permitted by applicable law, the Website and its content are provided on an “as available” basis for informational and marketing purposes. We do not guarantee uninterrupted operation, a particular result, the availability of a property, the accuracy of third-party information, or that a transaction will complete.
To the extent permitted by law, Kevin is not responsible for indirect or consequential loss arising solely from reliance on unverified listing information, third-party services, or an interruption outside his reasonable control. Nothing in these Terms excludes or limits liability for deliberate misrepresentation, fraud, gross negligence, death or personal injury caused by negligence where applicable, or any responsibility or mandatory consumer right that cannot lawfully be excluded or limited.
Each person remains responsible for their own decisions, inspections, professional advice, communications, credentials, and transaction documents. Any limitation must be interpreted narrowly and consistently with mandatory Lebanese law.
16. Governing law and courts
These Terms are governed by the laws of the Lebanese Republic. Subject to any mandatory rule that gives a consumer or another person the right to proceed elsewhere, disputes concerning these Terms or the Website are submitted to the competent courts of Beirut, Lebanon.
This clause does not prevent the parties from first attempting a reasonable informal resolution and does not waive mandatory legal or consumer rights.
17. General terms, changes, and contact
If a provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue where legally possible. A delay in exercising a right is not a waiver. No person other than the relevant parties receives an enforceable benefit under these Terms merely by reading them.
These Terms may be updated to reflect changes in the Website, services, or law. The last-updated date identifies the current version. Material changes should be communicated in a manner appropriate to their effect, and changes will not retroactively rewrite an existing signed agreement.
